    TREC (Texas Real Estate Commission)

    The state agency that administers and enforces TRELA, adopts the TREC Rules, and licenses and disciplines Texas real estate license holders.

    The Texas Real Estate Commission administers and enforces The Real Estate License Act (TRELA) and adopts the TREC Rules. It licenses and regulates sales agents, brokers, and inspectors, approves education, investigates complaints, and disciplines license holders through fines, suspension, and revocation. TREC does not write the statute; the Texas Legislature does that.

    TREC investigates complaints and may refer contested cases to the State Office of Administrative Hearings (SOAH) for a hearing. The Texas Real Estate Broker-Lawyer Committee drafts the promulgated contract forms that TREC adopts.

    On the exam

    The Legislature writes TRELA, TREC adopts rules to implement it, and SOAH hears contested factual disputes. Keep the three roles separate.

    Exam trap

    TREC enforces and adopts rules but does not create the statute. If a question asks who writes TRELA, the answer is the Texas Legislature.
