Agreement to These Terms

These Terms of Use (“Terms”) govern your access to and use of Pass Texas, including our mobile app, website, calculators, printable cheat sheets, emails, blog posts, practice questions, explanations, study tools, and related content (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Educational Exam Prep Only

Pass Texas is an educational study tool for people preparing for the Texas real estate sales agent exam. We are not the Texas Real Estate Commission (TREC), Pearson VUE, any real estate school, any government agency, or any licensing authority.

The Service is not a pre-license course, continuing education course, legal service, tax service, brokerage service, appraisal service, lending service, title service, insurance service, or closing service. Content is provided for exam preparation and general educational use only.

Remote Operation

Pass Texas is operated remotely and is not operated by a Texas government agency, licensing authority, or exam administrator. Although our content focuses on Texas real estate exam preparation, users are responsible for verifying all content against current Texas sources before relying on it for any purpose.

No Professional Advice

Pass Texas does not provide legal, tax, accounting, investment, lending, appraisal, brokerage, title, insurance, or closing advice. Calculators, formulas, examples, explanations, and printable sheets are built for Texas real estate exam practice. They should not be used to make an actual transaction, tax, legal, loan, appraisal, investment, title, or closing decision.

For real situations, consult the appropriate licensed professional or official source. For licensing rules and exam requirements, verify current information with TREC, Pearson VUE, the Texas Real Estate License Act (TRELA), the TREC Rules, and other official materials.

Accuracy, Updates, and Errors

We work to keep the Service accurate and useful, but laws, exam outlines, fees, forms, interpretations, and administrative rules can change. We do not warrant that every statement, calculator output, formula, example, source link, deadline, price, or exam reference will always be complete, current, or error-free.

You are responsible for checking official sources before relying on any rule, deadline, fee, formula, or exam requirement. If you find something that appears incorrect, please contact us so we can review it.

No Exam Guarantee

We do not guarantee that using Pass Texas will cause you to pass the Texas real estate exam, receive a license, improve a score, qualify for a license, or achieve any business result. Exam outcomes depend on many factors, including your study time, prior knowledge, test-day performance, course completion, TREC eligibility, application status, and Pearson VUE requirements.

Calculators and Study Tools

Calculator outputs, saved-result emails, cheat sheets, quizzes, readiness scores, practice assessments, study progress feedback, and study plans are educational estimates for practice. They may use simplified exam-style assumptions and may not reflect real closing statements, loan disclosures, tax bills, appraisals, brokerage agreements, title policies, or legal documents.

You are responsible for reading the question stem, choosing the correct inputs, checking the calculation, and confirming whether the tool fits the situation. If an output conflicts with an official source, contract, statute, rule, lender disclosure, closing document, tax bill, or licensed professional, do not rely on the Pass Texas output.

Purchases and Refunds

  • The Pass Texas mobile app may be available as a free download through the Apple App Store or Google Play Store.
  • Free access may include limited features, sample content, or other introductory functionality. Full access requires a paid upgrade or in-app purchase.
  • The paid upgrade unlocks the full version. The price is displayed before purchase and may vary by region, platform, taxes, promotions, or app store rules.
  • Pass Texas does not provide direct refunds for paid upgrades. Except where required by applicable law or app store policy, all purchases are final.
  • Payments, refund requests, chargebacks, and purchase disputes are handled by Apple or Google, depending on where the purchase was made, and are subject to that store’s terms and refund rules.
  • A paid upgrade gives you a personal, limited, revocable, non-exclusive, non-transferable license to use the unlocked features for your own exam preparation.
  • We may change which features are free or paid, but any refund or purchase restoration request must be handled through Apple or Google, depending on where the purchase was made.

Accounts and Security

If you create an account, you are responsible for keeping your login credentials secure and for activity under your account. Do not share, sell, transfer, or publish your account access. Notify us if you believe your account has been compromised.

Intellectual Property

The Service, including questions, explanations, calculator frameworks, cheat sheets, study materials, copy, design, graphics, software, logos, and other content, is owned by Pass Texas or its licensors and is protected by copyright, trademark, and other laws. You may use the Service for your own personal study. You may not copy, scrape, reproduce, sell, publish, distribute, use to train AI models, or create derivative works from our content except as expressly allowed by us in writing.

User Conduct

You agree not to:

  • Use the Service for unlawful, misleading, or abusive purposes.
  • Share, resell, sublicense, or transfer account access.
  • Copy, scrape, harvest, or redistribute Service content.
  • Reverse engineer, decompile, disrupt, overload, or interfere with the Service.
  • Remove copyright notices, disclaimers, source notes, or attribution from printable materials.
  • Present Pass Texas content as official TREC, Pearson VUE, legal, tax, lending, appraisal, or brokerage guidance.

Third-Party Services and Links

The Service may link to official sources, app stores, payment processors, analytics providers, email providers, authentication providers, and other third-party websites or services. We are not responsible for third-party content, policies, outages, errors, or practices.

Privacy

Our Privacy Policy explains how we collect, use, and protect information. By using the Service, you also agree to the Privacy Policy.

Changes to the Service or Terms

We may update, modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms. The “Last updated” date shows when the Terms were last revised. Continued use of the Service after changes means you accept the updated Terms.

Termination

We may suspend or terminate access to the Service if you violate these Terms, misuse the Service, infringe our rights, create risk for other users, or use the Service in a way that may expose Pass Texas to legal or security risk. Upon termination, your right to use the Service ends immediately.

Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, availability, or uninterrupted operation.

Limitation of Liability

To the maximum extent permitted by law, Pass Texas and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, exam failure, licensing delays, business losses, transaction losses, or any reliance on Service content, calculator outputs, emails, cheat sheets, or other educational materials.

To the maximum extent permitted by law, our total liability for any claim related to the Service will be limited to the amount you paid for your Pass Texas paid upgrade. Some jurisdictions do not allow certain limitations, so these limits apply only to the extent permitted by law.

Dispute Resolution

Any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Commercial Arbitration Rules or Consumer Arbitration Rules. Arbitration may be conducted in Texas or by video conference, unless applicable law requires a different location or procedure.

You and Pass Texas agree that disputes will be resolved only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated, or representative action. You and Pass Texas waive any right to a jury trial and any right to participate in a class action.

Either party may bring an individual claim in small claims court if the dispute qualifies. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property, confidential information, or Service security.

You may opt out of this arbitration agreement by sending written notice through our contact page within 30 days of your first use of the Service. Your notice must include your name, email address, and a clear statement that you opt out of arbitration.

Indemnity

You agree to defend, indemnify, and hold harmless Pass Texas from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, infringement of another person’s rights, or use of Pass Texas content outside its intended educational purpose.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. For disputes not subject to arbitration, any dispute will be handled in the state or federal courts located in Texas unless applicable law requires otherwise.

Acknowledgment

By accessing or using the Service, you acknowledge that you have read these Terms, understand them, and agree to be bound by them. You further acknowledge that Pass Texas is an educational study tool only and that you are responsible for verifying information before relying on it.
