Unlicensed Assistant
A person who performs clerical support for a brokerage but may not perform acts requiring a real estate license.
An unlicensed assistant may perform clerical and administrative support: scheduling, paperwork handling, and repeating factual information already published in a listing. What they may not do is perform an act requiring a license.
Sec. 1101.351(a) provides that a person may not act as a broker or sales agent without a license, and Sec. 1101.002 defines the acts that constitute acting as a broker, including negotiating and providing certain value analyses. No amount of broker approval authorises an unlicensed person to perform a licensed act.
