Buyer Representation Agreement
The written agreement that creates representation between a broker and a buyer, and that commonly supplies intermediary consent.
A buyer-representation agreement is the written contract that makes a buyer a client. It sets out the services, the term, whether it is exclusive, and the compensation arrangement.
It also does double duty for intermediary practice: under Sec. 1101.559(b) a buyer-representation agreement authorizing the broker to act as intermediary is sufficient to establish written consent, provided it sets out the Sec. 1101.651(d) prohibited conduct in conspicuous bold or underlined print.
