Client

The party a broker represents in a transaction, owed the duties that come with representation.

A client is the party a broker represents. Under TRELA Sec. 1101.557(a), a broker who represents a party in a real estate transaction, or who lists real estate for sale under an exclusive agreement for a party, is that party's agent. Representation is created by a written representation agreement, not by helping someone or answering their questions.

Because the broker is the client's agent, minimum services under Sec. 1101.557(b) apply: the broker must inform the client of material information related to the transaction, including the receipt of an offer, and must at a minimum answer the client's questions and present any offer to or from the client.

On the exam

Exam items test the client-customer line constantly. Look for a written representation agreement, not for who is being helped.

Exam trap

"The agent working with the buyer" does not mean the buyer is a client. Working with is not representing.
